Analysis Of Hernandez V. Texas - 1317 Words

Hernandez V. Texas is based in the 6th amendment, â€Å"guarantees a defendant a right to counsel in all criminal prosecutions†. This case is a very well-known because there was too much of discrimination towards Hispanics. Pedro Hernandez is a resident at Edna, Texas, a Mexican guy who was accused of convicting the murder of Joe Espinosa who was also a resident of the same area. Hernandez was found guilty by an all-white jury going all the way to Supreme Court. Their lawyers argue that it wasn’t fair for them not having a Mexican American as a jury and there was only Americans, because in that way they would take advantage of a Mexican American to do whatever they wanted to do with him. In the 1950’s was when this case occurred and also there was a harsh discrimination to Mexican Americans from the white people at the United States. Mexicans and African Americans were just a â€Å"waste of time† for the white people, that’s how the white people tho ught about them. History, discrimination and how did this issue impact police, court, and corrections are essential things that will be cover. Discrimination was a very harsh case to all Mexican Americans and also for the African Americans. What’s Worse? Many people face various addictions in the world today such as, drug, alcohol, sex, eating, or gambling addictions. One might ask the question, is one addiction more serious than another or are all addictions equally destructive? In particular, is an addiction such as gambling as serious as an addiction to drugs or alcohol? Research suggests a gambling addiction is less severe than a drug or alcohol addiction because drug or alcohol addictions are psychological and physical, can cause other addictions, can result directly in deaths, and can require medical intervention. â€Å"Pathological gambling is an impulse-control disorder that results in disruptions of personal, family, and vocational activities† (Ledgerwood).†¦show more content†¦Drug and alcohol addictions result in many deaths of teenagers, young adults, and adults. If a drug addict overdoses, he or she will die directly from his or her addiction. An alcoholic could do the same, if he or she were to get al cohol poisoning. Research shows â€Å"the death toll has doubled in the last decade, now claiming a life every 14 minutes†(Girion). These people addicted to drugs can die in many other ways too. For example, â€Å"a 19-year-old Army recruit, who had just passed his military physical, took a handful of Xanax and painkillers while partying with friends†(Girion) and died. People under the influence of drugs and alcohol cause many accidental deaths, including their own. According to the U.S. Department of Transportation in 2010, 10,288 people were killed in alcohol-impaired driving crashes accounting for nearly one-third of all traffic related deaths. On the other hand, a gambling addiction can cause one to lose all of his or her money, become depressed, and commit suicide. The final outcome would then be an indirect death caused by gambling. But, pathological gambling does not directly lead to death like a drug or alcohol addiction can. A drug or alcohol addiction can be treated with medication along with therapy, but a gambling addiction is treated mostly with therapy. At one of these sessions the topic discussed was motivation—how to motivate public servants to do a good job. The plight of a police captain became the central focus of the discussion: I’ve got a real problem with my officers. They come on the force as young, inexperienced rookies, and we send them out on the street, either in cars or on a beat. They seem to like the contact they have with the public, the action involved in crime prevention, and the apprehension of criminals. They also like helping people out at fires, accidents, and other emergencies. The problem occurs when they get back to the station. They hate to do the paperwork, and because they dislike it, the job is frequently put off or done inadequately. We need clear, factual reports. They must be highly detailed and unambiguous. As soon as one part of a report is shown to be inadequate or incorrect, the rest of the report is suspect. Poor reporting probably causes us to lose more cases than any other factor. I just don’t know how to motivate them to do a better job. We’re in a budget crunch, and I have absolutely no financial rewards at my disposal. In fact, we’ll probably have to lay some people off in the near future. It’s hard for me to make the job interesting and challenging because it isn’t-it’s boring, routine paperwork, and there isn’t much you can do about it. Finally, I can’t say to them that their promotions will hinge on the excellence of their paperwork. First at all, they know it’s not true. If their performance is adequate, most are more likely to get promoted just by staying on the force a certain number of years than for some specific outstanding act. Second, they were trained to do the job they do out in the streets, not to fill out forms. All through their careers the arrests and interventions are what get noticed. Some people have suggested a number of things, like using conviction records as a performance criterion. However, we know that’s not fair—too many other things are involved. Bad paperwork increases the chance that you lose in court, but good paperwork doesn’t necessarily mean ou’ll win. We tried setting up the team competitions based on the excellence of the reports, but the officers caught on to that pretty quickly. No one was getting any type of reward for winning the competition, and they figured why should they bust a gut when there was on payoff. I just don’t know what to do. Question: 1. What performance problems is the captain trying to correct? 2. Use the MARS model of individual behavior and performance to diagnose the possible causes of the unacceptable behavior. 3. Has the captain considered all possible solutions to the problem? If not, what else might be done? CASE: II How Did I Get Here? Something was not right. John Breckenridge opened his eyes, saw the nurse’s face, and closed them once more. Cobwebs slowly cleared from his brain as he woke up from his brain as he woke up from the operation. He felt a hard tube in his nostril, and tried to lift his hand to pull it out, but it was strapped down to the bed. John tried to speak but could make only a croaking sound. Nurse Thompson spoke soothingly, â€Å"Just try to relax, Mr. Breckenridge. You had a heart attack and emergency surgery, but you’re going to be OK. Heart attack? How did I get here? As the anesthesia wore off and the pain set in, John began to recall the events of the past year; and with the memories came another sort of pain – that of remembering a life where success was measured in hours worked and things accomplished, but which of late had not measured up. John recalled his years in college, where getting good g rades had been important, but not so much as his newly developing love for Karen, the girl with auburn hair who got her nursing degree the same year as he graduated with a degree in software engineering. They married the summer after graduation and moved from their sleepy university town in Indiana to Aspen, Colorado. There John got a job with a new software company while Karen worked evenings as a nurse. Although they didn’t see much of each other during the week, weekends were a special time, and the surrounding mountains and nature provided a superb quality of life. Life was good to the Breckenridges. Two years after they were married, Karen gave birth to Josh and two years later to Linda. Karen reduced her nursing to the minimum hours required to maintain her license, and concentrated on rearing the kids. John, on the other hand, was busy providing for the lifestyle they increasingly became used to, which included a house, car, SUV, ski trips, and all of the things a successful engineering career could bring. The company grew in leaps and bounds, and John was one of the main reasons it grew fast. Work was fun. The company was growing, his responsibilities increased, and he and his team were real buddies. With Karen’s help at home, he juggled work, travel, and evening classes that led to a master’s degree. The master’s degree brought another promotion—this time to vice president of technology at the young (for this company) age of 39. The promotion had one drawback: It would require working out of the New York office. Karen sadly said goodbye to her friends, convinced the kids that the move would be good to them, and left the ranch house for another one, much more expensive and newer, but smaller and just across the river in New Jersey from the skyscraper where her husband worked. Newark was not much like Aspen, and the kids had a hard time making friends, especially Josh, who was now 16. He grew sullen and withdrawn and began hanging around with a crowd that Karen thought looked very tough. Linda, always the quiet one, stuck mostly to her room. John’s new job brought with it money and recognition, as well as added responsibilities. He now had to not only lead software development but also actively participate in steering the company in the right direction for the future, tailoring its offerings to market trends. Mergers and acquisitions were the big things in the software business, and John found a special thrill in picking small companies with promising software, buying them out, and adding them to the corporate portfolio. Karen had everything a woman could want and went regularly to a health club. The family lacked for no material need. At age 41 John felt he had the world by its tail. Sure, he was a bit overweight, but who wouldn’t be with the amount of work and entertaining that he did? He drank some, a habit he had developed early in his career. Karen worried about that, but he reassured her by reminding her that he had been really drunk only twice and would never drink and drive. Josh’s friends were a worry, but nothing had yet come of it. Not all was well, however. John had been successful in Colorado because he thought fast on his feet, expressed his opinions, and got people to buy into his decisions. In the New York corporate office things were different. All of the top brass except the president and John had Ivy League, moneyed backgrounds. They spoke of strategy but would take only risks that would further their personal careers. He valued passion, integrity, and action, with little regard for personal advancement. They resented him, rightly surmising that the only reason he had been promoted was because he was more like he president than they were, and he was being groomed as heir apparent. On November 2, 2004, John Breckenridge’s world began to unravel. The company he worked for, the one he had given so much of his life to build was acquired in a hostile takeover. The president who had been his friend and mentor was let go, and the backstabbing began in earnest. John found himself the odd man out in the office as the others jostled to build status in the new firm. Although his stellar record allowed him to survive the first round of job cuts, that survival only made him more of a pariah to those around him. Going to work was a chore now, and John had no friends like those he had left in Aspen. Karen was little help. John had spent nearly two decades married more to his job than his wife, and he found she was more of a stranger than a comforter as he struggled in his new role. When he spoke about changing jobs, she blew up. â€Å"Why did I have to give up nursing for your career? † she said. â€Å"Why do we have to move again, just because you can’t get along at work? CASE: III The Shipping Industry Accounting Team For the past five years I have been working at McKay, Sanderson, and Smith Associates, a mid-sized accounting firm in Boston that specializes in commercial accounting and audits. My particular specialty in accounting practices for shipping companies, ranging from small fishing fleets to a couple of the big firms with ships along the East Coast. About 18 months ago McKay, Sanderson, and Smith Associates became part of a large merger involving two other accounting firms. These firms have offices in Miami, Seattle, Baton Rouge, and Los Angeles. Although the other two accounting firms were much larger than McKay, all three firms agreed to avoid centralizing the business around one office in Los Angeles. Instead the new firm—called Goldberg, Choo, and McKay Associates—would rely on teams across the country to â€Å"leverage the synergies of our collective knowledge† (an often-cited statement from the managing partner soon after the merger). The merger affected me a year ago when my boss (a senior partner and vice president of the merger) announced that I would be working more closely with three people from the other two firms to become the firm’s new shipping industry accounting team. The other team members were Elias in Miami, Susan in Seattle, and Brad in Los Angeles. I had met Elias briefly at a meeting in New York City during the merger but had never met Susan or Brad, although I knew that they were shipping accounting professionals at the other firms. Initially the shipping team activities involved e-mailing each other about new contracts and prospective clients. Later we were asked to submit joint monthly reports on accounting statements and issues. Normally I submitted my own monthly reports to summarize activities involving my own clients. Coordinating the monthly report with three other people took much more time, particularly because different accounting documentation procedures across the three firms were still being resolved. It took numerous e-mail messages an a few telephone calls to work out a reasonable monthly report style. During this aggravating process it became apparent—to me at least—that this team business was costing me more time than it was worth. Moreover, Brad in Los Angeles didn’t have a clue about how to communicate with the rest of us. He rarely replied to e-mail. Instead he often used the telephone tag. Brad arrived at work at 9:30 a. m. in Los Angeles (and was often late), which is early afternoon in Boston. I typically have a flexible work schedule from 7:30 a. m. to 3:30 p. m. so I can chauffeur my kids after school to sports and music lessons. So Brad and I have a window of less than three hours to share information. The biggest nuisance with the shipping specialist accounting team started two weeks ago when the firm asked the four of us to develop a new strategy for attracting more shipping firm business. This new strategic plan is a messy business. Somehow we have to share our thoughts on various approaches, agree on a new plan, and write a unified submission to the managing partner. Already the project is taking most of my time just writing and responding to e-mail and talking in conference calls (which none of us did much before the team formed). Susan and Brad have already had two or three misunderstandings via e-mail about their different perspectives on delicate matters in the strategic plan. The worst of these disagreements required a conference call with all of us to resolve. Except for the most basic matters, it seems that we can’t understand each other, let alone agree on key issues. I have come to the conclusion that I would never want Brad to work in my Boston office (thanks goodness he’s on the other side of the country). Although Elias and I seem to agree on most points, the overall team can’t form a common vision or strategy. I don’t know how Elias, Susan, or Brad feel, but I would be quite happy to work somewhere that did not require any of these long-distance team headaches. Question: 1. CASE: IV Conflict In Close Quarters A team of psychologists at Moscow’s Institute for Biomedical Problems (IBMP) wanted to learn more about the dynamics of long-term isolation in space. This knowledge would be applied to the International Space Station, a joint project of several countries that would send people into space for more than six months. It would eventually include a trip to Mars taking up to three years. IBMP set up a replica of the Mir space station in Moscow. They then arranged for three international researchers from Japan, Canada, and Austria 110 days isolated in a chamber the size of a train car. This chamber joined a smaller chamber where four Russian cosmonauts had already completed half of their 240 days of isolation. This was the first time an international crew was involved in the studies. None of the participants spoke English as their first language, yet they communicated throughout their stay in English at varying levels of proficiency. Judith Lapierre, a French-Canadian, was the only female in the experiment. Along with obtaining a PhD in public health and social medicine, Lapierre had studied space sociology at the International Space University in France and conducted isolation research in the Antarctic. This was her fourth trip to Russia, where she had learned the language. The mission was supposed to have a second female participant from the Japanese space program, but she was not selected by IBMP. The Japanese and Austrian participants viewed the participation of a woman as a favorable factor, says Lapierre. For example, to make the surroundings more comfortable, they rearranged the furniture, hung posters on the walls, and put a tablecloth on the kitchen table. â€Å"We adapted our environment, whereas Russians just viewed it as something to be endured,† she explains. We decorated for Christmas because I’m the kind of person who likes to host people. † New Year’s Eve Turmoil Ironically, it was at one of those social events, the New Year’s Eve party, that events took a turn for the worse. After drinking vodka (allowed by the Russian space agency), two of the Russian cosmonauts got into a fistfight that left blood splattered on the chamber walls. A t one point a colleague hid the knives in the station’s kitchen because of fears that the two Russians were about to stab each other. The two cosmonauts, who generally did not get along, had to be restrained by other men. Soon after that brawl, the Russian commander grabbed Lapierre, dragged her out of view of the television monitoring cameras, and kissed her aggressively—twice. Lapierre fought him off, but the message didn’t register. He tried to kiss her again the next morning. The next day the international crew complained to IBMP about the behavior of the Russian cosmonauts. The Russian institute apparently took no against the aggressors. Instead the institute’s psychologists replied that the incidents were part of the experiment. They wanted crew members to solve their personal problems with mature discussion without asking for outside help. You have to understand that Mir is an autonomous object, far away from anything,† Vadim Gushin, the IBMP psychologist in charge of project, explained after the experiment had ended in March. â€Å"If the crew can’t solve problems among themselves, they can’t work together. † Following IBMP’s response, the international crew wrote a scathing letter to the Russian institute and the space agencies involved in the experiment. â€Å"We had never expected such events to take place in a highly controlled scientific experiment where individuals go through a multistep selection process,† they wrote. If we had known†¦ we would not have joined it as subjects. † The letter also complained about IBMP’s response to their concerns. Informed about the New Year’s Eve incident, the Japanese space program convened an emergency meeting on January 2 to address the incidents. Soon after the Japanese team member quit, apparently shocked by IBMP’s inaction. He was replaced with a Russian researcher on the international team. Ten days after the fight—a little over the month the international team began the mission—the doors between the Russian and international crews’ chambers were barred at the request of the international research team. Lapierre later emphasized that this action was taken because of concerns about violence, not the incident involving her. A Stolen Kiss or Sexual Harassment By the end of experiment in March, news of the fistfight between the cosmonauts and the commander’s attempts to kiss Lapierre had reached the public. Russian scientists attempted to play down the kissing incident by saying that it was one fleeting kiss, a clash of cultures, and a female participant who was too emotional. â€Å"In the West, some kinds of kissing are regarded as sexual harassment. In our culture it’s nothing,† said Russian scientist Vadim Gushin in one interview. In another interview he explained, â€Å"The problem of sexual harassment is given a lot of attention in North America but less in Europe. In Russia it is even less of an issue, not because we are more or less moral than the rest of the world; we just have different priorities. † Judith Lapierre says the kissing incident was tolerable compared to this reaction from the Russian scientists who conducted the experiment. â€Å"They don’t get it at all,† she complains. â€Å"They don’t think anything is wrong. I’m more frustrated than ever. The worst thing is that they don’t realize it was wrong. † Norbert Kraft, the Austrian scientist on the international team, also disagreed with the Russian interpretation of events. â€Å"They’re trying to protect themselves,† he says. â€Å"They’re trying to put the fault on others. But this is not a cultural issue. If a woman doesn’t want to be kissed, it is not acceptable. † Question: 1. Identify the different conflict episodes that exist in this case. CASE: V Hillton’s Transformation Twenty years ago Hillton was a small city (about 70,000 residents) that served as an outer to a large Midwest metropolitan area. The city treated employees like family and gave them a great deal of autonomy in their work. Everyone in the organization (including the two labor unions representing employees) implicitly agreed that the leaders and supervisors of the organization should rise through the ranks based on their experience. Few people were ever hired from the outside into middle or senior positions. The rule of employment at Hillton was to learn the job skills, maintain a reasonably good work record, and wait your turn for promotion. Hillton had grown rapidly since the mid-1970s. As the population grew, so did the municipality’s workforce to keep pace with the increasing demand for municipal services. This meant that employees were promoted fairly quickly and were almost guaranteed employment. In fact, until recently Hillton had never laid off any employee. The organization’s culture could be described as one of entitlement and comfort. Neither the elected city council members nor the city manager bothered the department managers about their work. There were few costs controls because rapid growth forced emphasis on keeping up with the population expansion. The public became somewhat more critical of the city’s poor services, including road construction at inconvenient times and the apparent lack of respect some employees showed towards taxpayers. During these expansion years Hillton put most of its money into â€Å"outside† (also called â€Å"hard†) municipal services such as road building, utility construction and maintenance, fire and police protection, recreational facilities, and land use control. This emphasis occurred because an expanding population demanded more of these services, and most of Hillton’s senior people came from the outside services group. For example, Hillton’s city manager for many years was a road development engineer. The â€Å"inside† workers (taxation, community services, and the like) tended to have less seniority, and their departments were given less priority. As commuter and road systems developed, Hillton attracted more upwardly mobile professionals to the community. Some infrastructure demands continued, but now these suburban dwellers wanted more â€Å"soft† services, such as libraries, social activities, and community services. They also began complaining about how the municipality was being run. The population had more than doubled between the 1970s and 1990s, and it was increasingly apparent that the city organization needed more corporate planning, information systems, organization development, and cost control systems. Resident voiced their concerns in various ways that the municipality was not providing the quality of management that they would expect from a city of its size. In 1996 a new mayor and council replaced most of the previous incumbents, mainly on the platform of improving the municipality’s management structure. The new council gave the city manager, along with two other senior managers, an early retirement buyout package. Rather than promoting form the lower ranks, council decided to fill all three positions with qualified candidates from large municipal corporations in the region. The following year several long-term managers left Hillton, and at least half of those positions were filled by people from outside the organization. In less than two years Hillton had eight senior or departmental managers hired from other municipalities who played a key role in changing the organization’s value system. These eight managers became known (often with negative connotations) as the â€Å"professionals. † They worked closely with each other to change the way middle and lower-level managers had operated for many years. They brought in a new computer system and emphasized cost controls where managers previously had complete autonomy. Promotions were increasingly based more on merit than seniority. These managers frequently announced in meetings and newsletters that municipal employees must provide superlative customer service, and that Hillton would become one of the most customer-friendly places for citizens and those doing business with the municipality. To this end these managers were quick to support the public’s increasing demand for more soft services, including expanded library services and recreational activities. And when population growth flattened for a few years, the city manager and the other professionals gained council support to lay off a few outside workers due to lack of demand for hard services. One of the most significant changes was that the outside departments no longer held dominant positions in city management. Most of the professional managers had worked exclusively in administrative and related inside jobs. Two had Master of Business Administration degrees. This led to some tension between the professional managers and the older outside managers. Even before the layoffs, managers of outside departments resisted the changes more than others. These managers complained that their employees with the highest seniority were turned down for promotions. They argued for more budget and warned that infrastructure problems would cause liability problems. Informally these outside managers were supported by the labor union representing outside workers. The union leaders tried to bargain for more job guarantees, whereas the union representing inside workers focused more on improving wages and benefits. Leaders of the outside union made several statements in the local media that the city had â€Å"lost its heart† and that the public would suffer from the actions of the new professionals. Question: 1. The Butterfly Circus (Short Film) – A Reflection Paper The Butterfly Circus, a short film featuring Nick Vujicic in the lead role, is one of the best short films of the last few years. As his mentor, the owner of Butterfly Circus correctly points out, much of Nick’s predicament and diminished sense of self is of his own making. Admonishing Nick for his passive acceptance of fate, the mentor (played by Eduardo Verastegui) urges Nick to achieve something like other circus performers. Even when Nick falls down as he tries to cross over the river, the mentor allows him to ‘manage’ on his own. Apathetic and cruel as it might seem, Verastegui knew what he was doing – namely cultivating self-sufficiency in Nick. Just as Verastegui intended, this attitude leads to a breakthrough event, when Nick falls into the water, and in a desperate attempt to keep afloat, discovers that he can swim. It is only through trials and errors that come with persistent trying that they will be able to overcome their inhibitions and doubts and become self-sufficient, independent and successful. Hence, as a special education teacher, I will carry these messages of the film with me. As I completed watching the film, my mind tried to place the message of the film in the context of IDEA (Individuals with Disabilities Education Act), the country’s special education law. Though originally debated in the Congress in the 1970’s to ensure that children with special needs and disabilities had adequate opportunities to get appropriate public education, on par with children of normal ability, the recent amendments to the law were the most comprehensive, the final document of which was published two years back. It sets out many key components of IDEA as well as guidelines for educational institutions in regard to providing â€Å"special education and related services to more than six million eligible children with disabilities†. The three important components of IDEA are: Its Alignment with the No Child Left Behind Act, Early Intervening Services and Individualized Education Program (IEP). All these new requirements from the law are set to positively i mpact the way special needs children receive their education. Nevertheless, it remains to be seen if they meet all their objectives. I am just hoping that the provisions under IDEA help special needs children achieve their full potential as was brilliantly shown in The Butterfly Circus. I will also keep in mind a key message of the film – the social support a child receives in the form of its family, community, peers and school goes a long way in mitigating negative consequences – and try to provide such support to my pupils. It was a way for him to feel accepted and to feel comfortable with his surroundings. What Orwell wasnt aware of was the fact that he was portraying someone he really wasnt. By doing that he was lying to himself. Orwell was there representing the Britih; the last thing he would want to do is make himself look like a fool, in front of the Burmans. It would merely give them more reasons to laugh and taunt the British officers Going to another country, and having the responsibility of an officer, wasnt an easy task for Orwell. Before Reading the Passage Prepare students before they read the passage by explaining when to use the present simple tense and how to conjugate verbs in this tense. One of the great benefits of a joint tenancy with right of survivorship is that the property does not have to go through probate. Probate is often annoying and time-consuming. Joint tenants, however, do not have to go through probate for their property because the transfer of ownership is automatic. 1 Anent the desire of X to leave her share in the house to the charity in the will, my advise to her is that, under the doctrine of the right of survivorship (jus accrescendi), on the death of one joint tenant, the entire estate remains vested in the surviving joint tenants, who continue to be treated as a single unit. The deceased joint tenant’s interest ends on death and is sub sumed into the interests of the survivor(s) so that nothing passes to his beneficiaries. Unless the beneficial joint tenancy has been severed prior to death, the dead man’s estate will have no claim on the property in question. 2 The right of survivorship takes precedence over any disposition made in the deceased joint tenant’s will, or over any rules of intestacy. Hence, even if X will dispose her share in the house in her will, leaving this to the chosen charity, the same cannot be given credence. Linnet and her husband Simon go to Egypt to spend their honeymoon there. Jacqueline feels envy from Linnet because she steals her fiancà © from her, so she keeps following them everywhere they go. In the middle of the trip Linnet murders while she is on her honeymoon in the Nile. There are many suspects on the boat because many people hate her and have a motive for killing her. The detective Poirot who is in the same boat tries to figure out who kills Linnet and solves the problem. One major theme of the novel is how envy leads the person to kill others. The movie version of Agatha Christie’s popular novel Death on the Nile was released in September 1978, produced by Paramant Picture, directed by John Guillermin, and adapted for the screen by Anthony Shaffer. In this paper I will compare and contrast the manner in which one element has been adapted by the filmmakers and I will offer a hypothesis about why filmmakers make this change; in addition, I will synthesize the opinions of two film critics. One significant plot element that appears in the novel and that adapted for the film version concerns Colonel Race. The character of Colonel Race in the novel is overall similarity from the film. In the novel, Colonel Race is a man who travels round the world and solving important cases for the British government. The first time he shows in the novel is in Abu Simbel when he visits the temple; whereas, in the film the first time he shows in the hotel in Cairo with the first group. Also in the novel he has a motive for being in the boat and it is to follow Signor Richetti who is a criminal and pretending to be another person with a fake job, but in the film there isn’t any reason for Colonel Race to be on the boat with them. On the other h and, there are three similarities between the novel and the film about Colonel Race character. In novel and in the film Poirot is an old friend of Colonel Race and they meet each other after a long period of time. Also in the novel and the film Colonel helps his old friend Poirot who’s a detective to find out the crime and Colonel is monitoring others to catch who kills Linnet, Mrs. Otterbourne, and Miss Louise. Also in the novel and the film, there isn’t any motive for Colonel to kill Linnet. But, why did the adaptors make these changes? Perhaps the film adaptors couldn’t have forgotten how Colonel Race is in the book. For example, they couldn’t have forgotten that Colonel Race was in the novel for a secret mission to look for a criminal named Signor Richetti. Also, they couldn’t have forgotten that Colonel Race showed in the second group in half way through the trip in Abu Simbel. They may have believed that if they remove those events in the film, they will make it easily to understand what is going in the film. Also, not to make the movie complicated by adding more events. Maybe if Colonel Race showed in the second group, he will steal the audience attention from Jacqueline when she showed again in the second group. Also the audience will keep asking the question â€Å"Who’s this?!† in addition, Poirot will have someone to talk with from the beginning of the film and to show how they are very close to each other. In addition, they didn’t mention a criminal who was following by Colonel Race to catch him. That’s why they will confuse the audience because they will not know to focus on a criminal Signor Richetti himself or on the other criminal who killed Linnet, Mrs. Otterbourne, and Miss Louise. Thus, it seems likely that the film makers made their decision possibly to prevent confusion. Therefore, I think the decision to remove th ese events was good. Overall, the way the filmmakers changed these events is great and well thought out. Reactions to the writing of Anthony Shaffer by two critics appear to be almost diametrically opposed. In his 2011 contemporary review in The Stop Button, anonymous critic rates the film negatively overall and he has some comments about writing. The anonymous critic says, â€Å"The point of these Poirot films isn’t necessarily the filmmaking or the writing, it’s the all-star cast-it must be the cast, since relatively nothing happens for the first hour.† The anonymous critic thinks that Shaffer writing is not good enough and it is apparently not as strong as he was expecting. Actually, the anonymous critic seems that he doesn’t enjoy the writing section. Anthony Clarke opinion in his DVD.net.au review is the same as the anonymous opinion. Clarke has some reservations about the writing; he has certain comments about Peter Ustinov. Clarke says, â€Å"The plot has been trimmed down from Agatha Christie’s original, the novel seems widely implausible.† Clarke’s review of Shaffer’s work is overall not good. At most, one might see the two opinions about Shaffer’s writing as negative since an anonymous critic says the word â€Å"Isn’t necessarily†, and Anthony Clarke thinks that the writing is also negative when she says â€Å"Trimmed down.† The two responses to the writing of Anthony Shaffer in Death on the Nile are more similar than they are different. One major theme of the novel that I recognized and relate to is that how envy leads the person to kill others. Throughout the novel and film, Jacqueline feels envy from Linnet because she steals her fiancà © and marries him. Jacqueline decides to bother Linnet and destroys her life. Especially there are many people hate Linnet and feel envy from her because of many reasons. At the end Linnet murders by someone who feels envy from her and hates her very much. I can think of many examples of people who feel envy from others and finally the result is murdering them, but one example stands out strongly among all others. I knew my cousin neighbor and they are from Kuwait. Their neighbor called Fatima and she has three small children. One day Fatima husband told her that he want to marry another woman because our religion says that man can marry maximum four women. His wife Fatima can’t prevent him so she kept silence all the time and her heart full of envy from her husband and the woman who will be his second wife. Her husband decided to do a small wedding party in the tent. On the day of his wedding, Fatima wanted to destroy her husband wedding party. In the middle of the wedding, she set the tent on fire by using gasoline gallons. At the end, her husband and his new wife also some other guests died because what she had done. The police came and took her to the jail because it’s a murder case. So that, Fatima destroyed her life and her husband and others life because of her envy. So I suggest that people should take the life in easy way. They shouldn’t feel envy about others because the result will harm and destroy them and others. I advise people to try to delete the envy from their hearts and to accept the reality of their life. The Lift and Shift of the IVR Applications are recommended to have automation the least amount of human interaction to build and deploy onto AWS Cloud. This document will give a step-by-step process to carry out the task of automating the creation and maintenance of the applications. REQUIREMENTS The IVR Applications require the following resources to replicate and automate the on-premise environment onto AWS Cloud. In the Automation Process, the requirement is to have minimal human interaction and have an automation pipeline from creating a build for the application to creating, deploying and configuring until a running application instance is setup. The tools that are required are as follows: AWS EC2 Instances WebSphere Liberty Profile Jenkins Pipeline CyberArk Authentication Ansible Tower AWS CloudFormation AWS Elastic Load Balancers AWS S3 Bucket ELASTIC COMPUTE CLOUD (EC2) Elastic Compute Cloud (EC2) is a virtual computing environment which provides users the platform to create applications and allowing them to scale their applications by providing Infrastructure as a Service. Key Concepts associated with an EC2 are Virtual computing environments are known as instances. Preconfigured templates for your instances, known as Amazon Machine Images (AMIs), that package the bits you need for your server (including the operating system and additional software). Various configurations of CPU, memory, storage, and networking capacity for your instances, known as instance types. Secure login information for your instances using key pairs (AWS stores the public key, and you store the private key in a secure place). Storage volumes for temporary data thats deleted when you stop or terminate your instance, known as instance store volumes. Persistent storage volumes for your data using Amazon Elastic Block Store (Amazon EBS), known as Amazon EBS volumes. Multiple physical locations for your resources, such as instances and Amazon EBS volumes, known as regions and Availability Zones. A firewall that enables you to specify the protocols, ports, and source IP ranges that can reach your instances using security groups. Static IPv4 addresses for dynamic cloud computing, known as Elastic IP addresses. Metadata, known as tags, that you can create and assign to your Amazon EC2 resources. Virtual networks you can create that are logically isolated from the rest of the AWS Cloud, and that you can optionally connect to your own network, known as Virtual Private Clouds (VPCs). WEBSPHERE LIBERTY PROFILE IBM WebSphere Application Server V8.5 Liberty Profile is a composable, dynamic application server environment that supports development and testing of web applications. The Liberty profile is a simplified, lightweight development and application runtime environment that has the following characteristics: Simple to configure. Paramiko: A native Python SSHv2 channel library. Httplib2: A comprehensive HTTP client library. SSHPass: A non-interactive SSH password authentication. ANSIBLE FILE STRUCTURE Ansible Playbook is a model of configuration or a process which contains number of plays. Each play is used to map a group of hosts to some well-defined roles which can be represented by ansible call tasks. Master Playbook The Master Playbook file contains the information of the rest of the Playbook. The Master Playbook for the project has been given as Site.yml. This YAML script is used to define the roles to execute. NOTE: The roles in the Master Playbook are invoked to perform their respective tasks. Path = /ivr/aws_env/playbooks/ivr SITE.YML Inventory Ansible contains information about the hosts and groups of hosts to be managed in the hosts file. This is also called an inventory file. Path = /ivr/aws_env/playbooks/ivr/inventory Group Variables and Host Variables Similar to the hosts inventory file, you can also include hosts and groups of hosts configuration variables in a separate configuration folder like group_vars and hosts_vars. These can include configuration parameters, whether on the application or operating system level, which may not be valid for all groups or hosts. This is where having multiple files can be useful: inside group_vars or hosts_vars, you can create a group or host in more than one way, allowing you to define specific configuration parameters. Roles Roles in Ansible build on the idea of include files and combine them to form clean, reusable abstractions they allow you to focus more on the big picture and only define the details when needed. To correctly use roles with Ansible, you need to create a roles directory in your working Ansible directory, and then any necessary sub-directories. The Following displays the Playbook Structure for Ansible. ANSIBLE SETUP Ansible Setup is carried out on a managing server which has access to all your remote servers or nodes. The Process can be demonstrated with a few simple steps. Step I. Login as the Root User on the Instance where Ansible needs to be installed. Use the sudo apt-get install ansible -y command to install the package onto an Ubuntu/Debian System. Use the sudo yum install ansible -y command to install the package onto a CentOS/RHEL/Fedora System. Step II. The Ansible system can connect to any remote server using SSH by authenticating the request. NOTE: Ansible can use ssh-keygen to create a RSA encrypted key and can copy it to the remote server to connect using SSH without authentication. Step III. Create an Inventory file which is used to work against multiple systems across the infrastructure at the same time. This is executed by taking portions of the systems linked in the Inventory file. The Default path for the Inventory file is etc/ansible/hosts. NOTE This path can be changed by using -i which is a recommended option depending on the project requirement. There can be more than one inventory files which can be executed at the same time. The inventory file holds the group names which defines the group of servers that are maintained together. The inventory file needs to be populated with the host IP Addresses that are to be accessed. The inventory file is as follows: Path = /ivr/aws_env/playbooks/ivr/inventory hosts The IVR in the brackets indicates group names. Group names are used to classify systems and determining which systems you are going to control at what times and for what reason. The group name can be used to interact with all the hosts alongside different modules (-m) defined in ansible. Example: ansible -m ping IVR ANSIBLE CONFIGURATION The Configuration file for Ansible is used to make certain changes to the default configuration. The Priority configuration changes are searched by ansible in the following order: Path= /ivr/aws_env/playbooks/ivr/etc/ansible.cfg is the path setup for ansible configuration changes. CLOUD FORMATION AWS CloudFormation is a service that helps you model and set up your Amazon Web Services resources so that you can spend less time managing those resources and more time focusing on your applications that run-in AWS. You create a template that describes all the AWS resources that you want (like Amazon EC2 instances or Amazon RDS DB instances), and AWS CloudFormation takes care of provisioning and configuring those resources for you. You dont need to individually create and configure AWS resources and figure out whats dependent on what; AWS CloudFormation handles all of that. CloudFormation Template CloudFormation templates are created for the service or application architectures you want and have AWS CloudFormation use those templates for quick and reliable provisioning of the services or applications (called stacks). You can also easily update or replicate the stacks as needed. Example Template STEPS TO LAUNCH A CLOUD FORMATION STACK Sign in to AWS Management Console and open the Cloud Formation console at http://console.aws.amazon.com/cloudformation/ From the navigation bar select the region for the instance Click on the Create a New Stack. Choose an Option from a Sample Template, Template to S3 and S3 Template URL Using a template to build an EC2 Instance Enter a Stack Name and Provide the Key Pair to SSH into the Instance. a A Add Tags to the Instance, this also help organize your instance to group with application specific, team specific instances. Review and Create Stack. CloudFormation Stack starts building the stack using the template. In Scope of this Project, IVR Application Instances are build using a Cloud Formation Template and will be triggered using Ansible Role. Simple Storage Service (S3) Elastic Load Balancer (ELB) A load balancer serves as a single point of contact for clients, which increases the availability of your application. You can add and remove instances from your load balancer as your needs change, without disrupting the overall flow of requests to your application. Elastic Load Balancing scales your load balancer as traffic to your application changes over time, and can scale to the clear majority of workloads automatically. You can configure health checks, which are used to monitor the health of the registered instances so that the load balancer can send requests only to the healthy instances. You can also offload the work of encryption and decryption to your load balancer so that your instances can focus on their main work. ÂÂ  Setting Up an Elastic Load Balancer Step 1: Select a Load Balancer Type Elastic Load Balancing supports two types of load balancers: Application Load Balancers and Classic Load Balancers. To create an Elastic Load Balancer, Open the Amazon EC2 console and choose Load Balancers on the navigation pane. Step 2: Configure Your Load Balancer and Listener On the Configure Load Balancer page, complete the following procedure. To configure your load balancer and listener 1. For Name, type a name for your load balancer. The name of your Application Load Balancer must be unique within your set of Application Load Balancers for the region, can have a maximum of 32 characters, can contain only alphanumeric characters and hyphens, and must not begin or end with a hyphen. 2. For Scheme, keep the default value, internet-facing. 3. For IP address type, select ipv4 if your instances support IPv4 addresses or dual stack if they support IPv4 and IPv6 addresses. 4. For Listeners, keep the default, which is a listener that accepts HTTP traffic on port 80. 5. For Availability Zones, select the VPC that you used for your EC2 instances. For each of the two Availability Zones that contain your EC2 instances, select the Availability Zone and then select the public subnet for that Availability Zone. 6. Choose Next: Configure Security Settings. Step 3: Configure a Security Group for Your Load Balancer The security group for your load balancer must allow it to communicate with registered targets on both the listener port and the health check port. The console can create security groups for your load balancer on your behalf, with rules that specify the correct protocols and ports. Note If you prefer, you can create and select your own security group instead. For more information, see Recommended Rules in the Application Load Balancer Guide. On the Configure Security Groups page, complete the following procedure to have Elastic Load Balancing create a security group for your load balancer on your behalf. Step 4: Configure Your Target Group To configure a security group for your load balancer 1. Choose Create a new security group. 2. Type a name and description for the security group, or keep the default name and description. This new security group contains a rule that allows traffic to the load balancer listener port that you selected on the Configure Load Balancer page. 3. Choose Next: Configure Routing. Step 4: Configure Your Target Group Create a target group, which is used in request routing. The default rule for your listener routes requests to the to registered targets in this target group. The load balancer checks the health of targets in this target group using the health check settings defined for the target group. On the Configure Routing page, complete the following procedure. To configure your target group 1. For Target group, keep the default, New target group. 2. For Name, type a name for the new target group. 3. Keep Protocol as HTTP and Port as 80. 4. For Health checks, keep the default protocol and ping path. 5. Choose Next: Register Targets. Step 5: Register Targets with Your Target Group On the Register Targets page, complete the following procedure. To register targets with the target group 1. For Instances, select one or more instances. 2. Keep the default port, 80, and choose Add to registered. 3. If you need to remove an instance that you selected, for Registered instances, select the instance and then choose Remove. 4. When you have finished selecting instances, choose Next: Review. Step 6: Create and Test Your Load Balancer Before creating the load balancer, review the settings that you selected. After creating the load balancer, verify that its sending traffic to your EC2 instances. To create and test your load balancer 1. On the Review page, choose Create. 2. After you are notified that your load balancer was created successfully, choose Close. 3. On the navigation pane, under LOAD BALANCING, choose Target Groups. 4. Select the newly created target group. 5. On the Targets tab, verify that your instances are ready. If the status of an instance is initial, its probably because the instance is still in the process of being registered, or it has not passed the Auto Scaling AUTOMATION OVERVIEW There are 2 Parts of the Automation Process which is used To Create a Custom AMI for all IVR Applications To Create Instances for Each Application using the Custom AMI. STEPS TO CREATE THE CUSTOM AMI The process of automating this environment starts from creating a Jenkins Pipeline for code deploy to the application that needs to be build. The Pipeline also needs integration of CyberArk for the Authentication and registering the service account required for the automation. The following process is triggered as part of the Ansible playbook where it performs multiple roles to complete automation of the Application. The Ansible role first calls for a CloudFormation Template. A CloudFormation Template is used to Build a Stack required (EC2 Instance). This template is given the AMI ID of the Verizon standard. The CloudFormation Template after the creation of the Instance triggers a WebSphere Role from Ansible that installs the OpenJDK, WebSphere Liberty Profile, creating a WLP User and Add the Necessary Net groups for the application. An AMI of the Instance at this point is created. STEPS TO CREATE THE APPLICATION INSTANCES The process of automating this environment starts from creating a Jenkins Pipeline for code deploy to the application that needs to be build. The Pipeline also needs integration of CyberArk for the Authentication and registering the service account required for the automation. The following process is triggered as part of the Ansible playbook where it performs multiple roles to complete automation of the Application. The Ansible role first calls for a CloudFormation Template. A CloudFormation Template is used to Build a Stack required (EC2 Instance). This template is given the Custom AMI created for IVR. After the creation of the Instance an S3 Role is triggered from Ansible. The S3 Role Performs the Ansible Role based on the Application Instance. NOTE: An S3 Bucket with folder structure for each application is maintained to keep the updated code and certificates along with other required installation files. IVR Touch Point S3 role fetches the EAR files, configuration files and the certificates in the IVR-TP folder of the S3 bucket and install them on the Instance that is created by the Cloud Formation Role. IVR Middleware S3 role fetches the EAR files, configuration files and the certificates in the IVR-MW folder of the S3 bucket and install them on the Instance that is created by the Cloud Formation Role. IVR Activations S3 role fetches the EAR files, configuration files and the certificates in the IVR-Activations of the S3 bucket and install them on the Instance that is created by the Cloud Formation Role. IVR CTI S3 role fetches the IBM eXtreme Scale Grid Installation followed by Siteminder SSO installation. After the application requirements are fulfilled, the EAR files, configuration files and the certificates in the IVR-CTI folder of the S3 bucket are deployed on the Instance. IVR Work Hub S3 role fetches the IBM eXtreme Scale Grid Installation followed by Siteminder SSO installation.
